SUNRISE BEACH, Mo. — Another rezoning request from Magruder Quarry and Equipment has met monolithic opposition from the Sunrise Beach Board of Trustees.

On Monday, Aug. 12 the board voted to oppose a revised request made to the Camden County Planning and Zoning Commission last month by Mark Magruder, of Magruder Quarry and Equipment, and Charles and Phyllis Turner. The request was to rezone property from A-R to B-2.

The board on Monday also opposed a request by Magruder for a Special Use Permit.

The vote came on the heels of a recommendation by the Sunrise Beach Planning and Zoning Commission to oppose the Special Use Permit request.

The commission’s recommendation was made at its Monday, Aug. 5 meeting. Planning and Zoning Commissioner/Board Trustee Ray Kline abstained from that vote because he would be subsequently voting at the trustee meeting.

The Sunrise Beach Board of Trustees and the Sunrise Beach Planning and Zoning Commission have opposed a previous attempt by Magruder to rezone the same property from A-R to B-3. The board at that time sent a letter to the Camden County Planning and Zoning commission requesting it follow suit.

This official opposition by Sunrise Beach will now require a super-majority to approve the case in Camden County.

The village and county have an Urban Service Boundary Agreement which entitles the village to officially comment on Camden County Planning and Zoning cases which involve property within 1.5 miles of the village.

Magruder's newest request included the rezoning of an approximately 30-acre tract of land. The application stated the proposed purpose for rezoning was the establishment of a commercial shopping center, or possible big box store, developed in conjunction with the current C-2 zoned property to the north of the Village of Sunrise Beach.

Magruder has also requested a Special Use Permit from the Camden County Board of Adjustments to quarry, mine and sell rock to grade for potential business development on a piece of property in Camden County, just outside Sunrise Beach village limits.

The Camden County Planning and Zoning Commission and the Camden County Board of Adjustments tabled any decision on that permit and requested additional information from Magruder. The request included a traffic study, the intended amount of soil volume to be removed, a grading plan, more specifics, and necessary changes in the application language.

Sunrise Beach City Planner Roger Corbin noted that compliance with county code requirements would likely be costly for Magruder.

When Magruder presented his case to the Sunrise Beach Planning and Zoning Commission, residents who live near the quarry voiced their opposition, citing concerns the expansion would lower property values, be detrimental to the health and living conditions of the people in the neighborhood, and damage the ecosystem.

In other Sunrise Beach Planning and Zoning Commission business, the commission elected Dawn Merrill as the new commission chairman. Merrill has been a member of the commission since it started in 2008. Don Hueschle resigned as chairman in March to pursue an increase in activities with the United States Coast Guard Auxiliary. Current board members include; Rick Escabedo, Ray Kline, Ken Gerardy, Kent Morris, Rhonda Boyert and Merrill.

The next planned meetings:
