CAMDEN COUNTY, Mo. — The Camden County Planning & Zoning Commission last week gave its approval to a permit for outdoor entertainment at a local event venue.

P&Z approved recommending a request by Bruce and Gena Aldrich, Lake Breeze Point, LLC for a Conditional Use Permit (CUP) to allow outdoor entertainment on property located at 7127 Old Route 5 in Camdenton. The approval was granted at the Wednesday, March 16 P&Z commission meeting.

The subject property is zoned B-2. The surrounding properties are zoned R-1 LDR and B-2 General Commercial. The property is currently used as an indoor banquet hall.

The Aldriches requested the CUP to allow for outdoor entertainment on an existing patio and deck for weddings, receptions, parties, catered dining, etc. The Aldriches agreed to stipulate in the rental contact to a quiet time starting at 11 p.m. They also stated that the maximum number of guests will be limited to 110. If the CUP is approved by Camden County Commissioners, it will only apply to the current applicant and is non-transferrable.

Preliminary plat approved in Camdenton

In other P&Z business, the commission approved recommending a preliminary plat request by Jacob Neusche, Neu-Sol Developments LLC, for property located in the Star View Subdivision in Camdenton. The property consists of six residential lots, six accessory use lots and a utility tract. The properties are located in an R-1 Low Density Residential district.

Due to Neusche serving as a P&Z Commissioner, he abstained from voting on the decision concerning his own properties.

If approved by the Camden County Commission, Neusche’s proposed use for the property is to construct single family homes and accessory garages, which will only be available to homeowners within the subdivision. The property is bounded on all sides by R-I Low Density Residential, except on the north, which is zoned P-2 Commercial Park.

The lots meet the Camden County Unified Land Use Code (ULC) minimum lot size requirement; have adequate road frontage and utility systems, and they adhere to ULC zoning compliance.

On the future development map, the property is identified as a Suburban Neighborhood. A surety bond or Irrevocable Standby Letter of Credit will be posted for public improvements equal to 1.5 times the engineer’s estimate.

Conditional requirements

Accessory lots one through six will have to be dedicated strictly to residential use, accessory lots cannot be sold to any other person or entity outside of the subdivision and no accessory structure can be used as commercial.

Osage Beach rezone/re-plat request approved

The P&Z commission also approved recommending a request by JBWC Properties LLC to rezone Lots 3 and 4 of Tahoe Lake Estates Subdivision from R-1 LDR to B-2 General Commercial. The commissioners also recommended approval of an administrative re-plat with variances to the United Land Use Code, ULC, by the Board of Adjustment, BOA.

The property is located at 1156 Runabout Drive in Osage Beach. The subject property and surrounding properties are zoned R-1 Low Density Residential. This area has several metal commercial type garage buildings on lots that are also zoned R-1. The lots do not have subordinate principal use residential structures pursuant to the ULC. Some of the garage structures are used for personal storage and others have businesses operated out of them.

If approved by the Camden County Board of Adjustment and the Camden County Commission, the applicant intends to combine Lots 3 and 4 into Lot 3 pursuant to the Amended Plat of Lot 3. The amended plat cannot be approved administratively until the BOA approves a variance to the minimum lot size requirement and a variance to the setback requirements for B-2 General Commercial. The combined lots total 9,362 s.f. and B-2 zoned property, according to the ULC, minimum lot size requirements are 22,000 s.f. Three sides of the existing building do not meet B-2 minimum set back requirements of 20 ft. on each side, 20 ft. rear and 30 ft. on the front. The amended plat approval is subject to the successful rezoning of the property as well as BOA approval of all required variances.

Rezone and re-subdivision in Osage Beach tabled

The commission tabled a request by Casey Boaz to rezone Lots 23 – 30, Block 3, Tahoe Lake Estates, Unit No. 1 from R-1 LDR to B-2 General Commercial and approval of a re-subdivision plat with approval variances to the ULC from the BOA. The property is located at 1242, 1246, 1250 and 1252 Runabout Drive in Osage Beach.

The subject property and surrounding properties are zoned R-1 LDR. The area has several metal commercial type garage buildings on lost that are zoned R-1. The lots do not have subordinate principal use residential structures as pursuant to the ULC. Some of the garage structures are used for personal storage and others have businesses operated out of the structures.

Boaz intends to combine the eight lots into three lots pursuant to the re-subdivision of Lots 23 through Lots 30. The re-subdivision cannot be approved until the BOA approves a variance to the minimum lot size requirement and variances to the setback requirements for B-2 General Commercial. Lot one totals 9,749 s.f. and Lot 2 totals 10,661 s.f. Minimum s.f does not meet the ULC minimum lot size requirement for B-2. The proposed buildings will also require approved variances from the BOA prior to the issuance of a construction permit.

This decision was tabled because P&Z commissioners were not comfortable with three of the lots being under the ULC 22,000 s.f. minimum lot size requirement. Boaz will go back and refigure lot sizes with a surveyor. The case will then go before the Camden County Board of Adjustment at 5:30 p.m. on Wednesday, March 23 for the purpose of obtaining the variances to set back requirements to comply with B-2 zoning. This re-subdivision plat approval is subject to successful rezoning of this property and approval by the BOA of all required variances.

Re-zone approved in Camdenton

The commission approved recommending a request by Dale Bilyeu to rezone property located at 250 Wego Fish Lane, from R-1 Low Density Residential to B-2 General Commercial. The property consists of approximately 4,700 s.f. and does not meet the ULC minimum lot size requirement for B-2 General Commercial. The lot also does not meet the minimum size requirement for its existing zoning of R-1 LDR and is considered a pre-existing non-conforming situation pursuant to Article 700. The surrounding properties are zoned R-1 LDR and B-2 General Commercial. The decision will go before the Camden County Commission at 10 a.m. on Thursday, April 21.
