KANSAS CITY, Mo. — The Missouri Supreme Court will decide on whether the case of Aaron Fisher, who admitted to raping his infant daughter in Miller County, Mo., was right to be dismissed.
Cole County Circuit Judge Patricia Joyce ruled in late-2015 that Fisher’s constitutional right to a speedy trial had been violated, following approximately six years of legal wrangling. Joyce dismissed the rape charges against Fisher, whose daughter had been six months old when he confessed to raping and assaulting her.

Recently, the Missouri Western District Appeals Court unanimously upheld Joyce’s ruling. But the Missouri Attorney General’s office has filed for a rehearing, and the case has been reassigned to the Missouri Supreme Court.
Meanwhile, Fisher is facing an assault charge, connected to the same incident. He spent approximately a year out of jail, before Miller County Prosecutor Ben Winfrey filed the assault charge. Fisher was arrested in Bowling Green, Ohio.
