CAMDEN COUNTY, Mo. — A Sunrise Beach couple has given a little, to settle a property issue that previous owners battled over in court.
A neighbor's patio on the south side of Jeff and Ruth Grays' property is encroaching over onto their property. Jeff Gray is working with the current owner of the lot (Odenthal) and has come up with a plat to resolve the encroachment issue. In the end, Jeff Gray said he'd be willing to carve out a piece of his property to solve the problem.
Jeff Gray said after he acquired the property in 2013, he became aware his property line ran across his neighbor’s patio. Previous owners have battled in two court cases to try and solve this issue.
“I told them when it was all said and done I would just give them the property,” Jeff Gray said. “I am trying to clean up a mess that has been here for 40 years.”
After a public hearing, with no comments, the Camden County Planning & Zoning Commission approved recommending a request by the Grays for a preliminary plat known as Sansone's Last, located at 35 Five Acres Road in Sunrise Beach.
“It actually cleans up a zoning issue,” Camden County Planning and Zoning Administrator Kim Willey noted.
The property and the surrounding properties are zoned R-1 (Low Density Residential). The Grays' property is previously un-platted and this action seeks to plat the property into three R-1 zoning compliant lots in the Sansone’s Last Subdivision, with Lot 4 being known as Well Lot.
- Lot 1 will consist of a 20389.83 s.f. and contain a pre-existing non-conforming A-Frame Home.
- Lot 2 will consist of 20,389.83 s.f. and contain a pre-existing home.
- Lot 3 will consist of 11,014.64 and contain a pre-existing non-conforming house and improvements.
The Grays plan to sell a residence on Lot 2 and reside in another.
These cases will now be sent to the Camden County Commission for a final decision.
