LAKE OZARK, Mo. — Two people were arrested after one allegedly fired multiple rounds from a vehicle near Alley Cats, on the Bagnell Dam Strip, on Memorial Day.
On Monday, May 30 at around 11 p.m., authorities say they were called to the scene of Alley Cats in response to shots being fired. Police say they discovered that two men, Shane Foss and David Davis, had been asked to leave Alley Cats, but as they left in a vehicle, Davis allegedly fired multiple rounds from a handgun into the air. Police say there were no injuries and no property damage from the gunshots.
An officer reported finding six bullet casings at the scene. Authorities put out an area broadcast with the vehicle's description, and approximately four hours later police say they located the subject's vehicle at Days Inn in Osage Beach. After further investigation, the suspects were located by the Camden County Sheriff's Department in an apartment on Horseshoe Bend.
The two men were taken into custody and deputies seized the 9mm handgun believed to be used in the incident was located. They also seized a high-capacity magazine and 100-round drum for the handgun.
According to the probable cause document for the arrest, Foss told authorities the gun belonged to him, but Davis had fired it. Davis admitted to firing it, the document reveals, noting he completed a voluntary statement reading the following:
"Me and Shan was at the bar I was having a good time then he told me we had to leave and I asked him why he said because he had a gun then we left and he gave me the gun and said let some shots out I wasn’t intending to hurt anyone I just shot it in the air being stupid because I was drunk. I was not planning on hurting anyone at no means."
Davis was charged with Class B Felony Unlawful Use of a Weapon.
Foss was charged with the same Class B felony, as well as Class D Felony Unlawful Possession of a Firearm, due to a prior felony conviction.
