It happened quickly, quietly, without media alarm. The SECURE Act moved through Congress and the President signed it into law before anyone with an IRA or 401K knew what happened. Now, investors are scrambling to protect their families from future tax burdens.

While cloaked by near-term benefits for retirement savings, The SECURE Act undermines investors that have for many decades used Traditional IRAs and 401Ks to build financial legacies for their families. While the government-created system has for a generation incentivized building estates through IRAs, politicians have now changed the rules in one swift motion by increasing the tax burden on heirs.

At the heart of the issue: The Stretch.

Before The SECURE Act’s passage, a son, daughter or even a grandchild could inherit an IRA and stretch required minimum distributions over time, based on their life expectancy: often over multiple decades. The SECURE Act changed this as of Jan. 1, 2020, now requiring heirs (with a few exceptions, including spouses) to take the entire value of a beneficiary IRA within 10 years. Since the majority of heirs are in their 40s or 50s, at the peak of their earnings potential, the new law in many cases pushes them into higher tax brackets, effectively eroding family wealth, threatening retirement and making it more difficult to provide for the next generation.
